Demerit point offence notification
If you commit an offence which carries demerit points, VicRoads will send you a letter which lists how many demerit points you have accumulated and the details of the offence(s).
If you:
* have a full driver licence and get 12 or more demerit points in any 3 year period; or
* have a learner permit or probationary driver licence and you get 5 or more demerit points in any 12 month period or you get 12 or more demerit points in any 3 year period,
you will be advised by VicRoads that you have these demerit points and given a notice with two options, as follows.
Options available
Option 1: Keep your Permit / Licence
You can elect to keep your licence but you must not accumulate any other demerit points during a 12 month period specified on your option notice or your licence/permit will be suspended for double the time that it would have been suspended under option 2.
If you choose option 1 you should call VicRoads on 1300 555 325 (this automated service is available 24 hours a day, seven days a week) and confirm your option selection at least seven days before the option 2 suspension is scheduled to commence.
Option 2: Suspend your Permit / Licence
If you choose option 2 you do not need to respond to the option notice. Your licence suspension will commence on the date specified in this notice. The suspension period will be three months for the first 12 points (or 5 points if you have a learner permit or probationary licence) plus one month for every additional four points listed in the option notice.
A demerit point suspension cannot be imposed or operate concurrently with any other licence suspension or cancellation.
From 1 July 2007, new restrictions on driving high powered vehicles will be introduced for probationary licence drivers who obtain their licence from 1 July 2007.
From this date a probationary licence holder will not be able to drive a vehicle if it has:
* An engine of eight or more cylinders;
* a turbocharged or supercharged engine (except diesel powered vehicles);
* an engine that has been modified to increase its performance; and/or
* certain high performance six cylinder cars. An official list of nominated vehicles will be published on this website from 1 July 2007. In the interim it is expected to include the following vehicles:
o the BMW M and M3,
o Nissan 350Z,
o Porsche (all models), and
o Mercedes Benz SLK350.
Vehicles which are excluded from these restrictions are:
* Turbocharged or supercharged diesel powered vehicles (without engine performance modifications);
* all models of the Smart car, produced by Mercedes Benz; and
* nominated vehicles with low powered turbocharged or supercharged engines. These vehicles include the following vehicles:
o Suzuki Cappucino 2D Cabriolet Turbo 3 cylinder 689cc, and
o Daihatsu Copen L880 2D Convertible 4 cylinder 659 cc.
The current power to weight restrictions will continue to apply for drivers who obtain their probationary licences before 1 July 2007.
If you want to buy a vehicle and are unsure whether it is high powered, the first step is to ask the seller or dealer prior to buying the vehicle or contact the manufacturer directly for more information. If you are still unsure or doubt the information given, seek further advice from a licensed mechanic.

If you obtained your P plates on or before 30 June 2007, a high powered vehicle is considered to be any vehicle with a power to weight ratio over 125 kw per tonne, or with an engine capacity to weight ratio over 3.5 litres per tonne. This includes any make of car.

* calculate the capacity to weight ratio
If your car is modified, you may also need to obtain an engineer's certificate and do your own calculations. You are also required to notify VicRoads of any significant modification. Penalties for not doing so are tough.

* Capacity to weight ratio is the capacity in litres divided by the weight in tonnes
* Power to weight ratio is the power in kw divided by the weight in tonnes.
For the calculations, weight is specified in tonnes (1000kg = 1 tonne); capacity is specified in litres (1000ml = 1 litre); power is specified in kilowatts (kw) and is measured at the engine flywheel.
The weight of a vehicle is the unladen mass specified by the manufacturer for the stock standard vehicle (without options).
For example, if a V8 vehicle weighs 1382kg with a power rating of 185kw, then the power to weight ratio is: 185/1382 x 1000 = 130kw per tonne. This vehicle would therefore be considered a high powered vehicle, because it is over 125 km per tonne.
